DuPlain Law assists clients in achieving their personal and business planning goals. We have 20 years of experience in counseling privately owned businesses, various trusts, and the administration of trusts and estates. DuPlain Law also helps clients develop estate plans involving wills and non-probate transfers to provide our clients with the peace of mind that their assets will pass smoothly to future generations.

Estate Planning: Estate planning is a process that involves long-term planning to provide solutions tailored to each client’s needs, not just preparing wills and trusts. DuPlain law provides a plan that meets your specific tax and family needs. We provide advice to enable wealth to pass to your intended beneficiaries in the most tax-efficient manner.

Probate, Estate, and Trust Administration: We advise individual and corporate fiduciaries who handle the administration of estates and trusts. The estates we administer include decedents’ estates and guardianship estates for minors and disabled adults. We assist the fiduciaries of a decedent’s estate through the probate process, appearing in court, guiding them in the transfer of assets and resolution of claims, as well as the implementation of the decedent’s estate plan. We regularly prepare federal estate tax returns. We also advise and apply post-mortem planning techniques to minimize and defer taxes. We assist trustees in administering trusts created upon a client’s death and trusts created by our clients during their lifetimes to implement their estate plans or particular family planning objectives.

We also represent fiduciaries and individuals in the construction and reformation of wills and trusts when provisions are unclear or tax laws have changed, resulting in unforeseen consequences from provisions in irrevocable documents. Our tax and administrative experience offers substantive and procedural advice for interpreting irrevocable documents and to present options to resolve the issues.

Planned Giving: We advise clients in selecting the gifting options that will accomplish their personal objectives while integrating both income and gift tax techniques. We assist our clients by creating and administering charitable remainder trusts and charitable lead trusts, donor-advised funds, private foundations, and supporting organizations. We regularly advise our clients on gifts of appreciated property, creating charitable contribution programs integrated into their estate plan, and the design of vehicles to involve younger family members in charitable giving.

Before opening DuPlain Law, David amassed more than 12 years’ experience as a legal accountant working in the area of estate planning and administration.  Along with handling standard estate and trust matters, David can counsel clients on:

  • lifetime transfer planning
  • charitable endowment planning

Additionally, David can advise business owners on:

  • maintaining proper corporate record books
  • business succession planning and recapitalization
